Golden Gavel Auction Group, LLC - General Terms & Conditions

These are the general terms and conditions for registering on this site. Each auction will have its own specific terms. Please review both these general terms and the terms for each individual auction carefully before participating.


1. Auction Participation & Bidding

 

  • Golden Gavel Auction Group, LLC ("Auction Company") provides an Internet auction as a service to bidders.

  • Bidders acknowledge that the online auction service may or may not function correctly on auction day. Auction Company is not responsible for any missed bids due to Internet failure or technical issues.

  • Bidders who want to ensure their bid is acknowledged should use the proxy bidding feature and place their maximum bid at least 24 hours before the auction closes.

  • Auction Company reserves the right to withdraw or re-catalog items at any time.

  • Bidders should verify all information and make their own decisions before bidding.

  • Auction increments are pre-set on the bidding webpage.

  • The Auction Company and the seller reserve the right to bid on items with unpublished reserve prices up to the reserve amount.

  • The Auction Company may reject or cancel any bid for any reason.

  • The auction record maintained by Golden Gavel Auction Group, LLC shall be conclusive.

  • This is a public auction; all qualified bidders, including Auction Company owners, employees, affiliates, and their families, may participate.

  • The Auctioneer has the right to reject bids that are not commensurate with the value of the item and may withdraw the item if necessary.

2. Buyer's Contract

  • By placing a bid, you enter into a binding contract to purchase the item if you are the winning bidder.

  • If you cannot pay for or pick up the items during the designated time, you must not bid.

3. Payment Terms

  • Payment Methods: Visa, MasterCard, Discover, or American Express.

  • Credit Card Authorization: By providing your credit card information, you authorize Golden Gavel Auction Group, LLC to charge your card for the purchase amount, applicable taxes, shipping costs (if any), and handling fees (if any).

  • Credit Card Retention: Your credit card information will be kept on file as long as you maintain an account with the Auction Company.

  • Settlement of Accounts: All accounts will be settled at the conclusion of the auction.

  • Declined Payments: A $25 service fee will be charged for declined credit card transactions that require additional time and contact to resolve.

  • Currency Type: All transactions are in USD.

  • Credit Card Surcharge: A 3.5% surcharge applies to credit card payments.

4. Buyer's Premium & Sales Tax

  • Buyer's Premium: A 10% buyer's premium will be added to the final bid amount to determine the total purchase price.

  • Sales Tax: A 6% Kentucky sales tax applies to applicable items unless the buyer provides a valid farm or tax exemption certificate.

5. Pickup & Shipping

  • Pickup Requirements: You must pick up your item on the designated date; otherwise, the item will be considered abandoned and become the property of the Auction Company.

  • Pickup Location: Pickup locations will be specified in the terms for each auction. The exact location will be announced to winners at the close of the auction.

  • Pickup Dates & Times: Specified per auction or by arrangement with the Auction Company.

  • Shipping Policy:

    • Golden Gavel Auction Group, LLC does not arrange shipping.

    • Buyers are responsible for all shipping arrangements and costs.

    • Buyers must contact their preferred shipping company at their own risk.

6. Participation Requirements

  • To bid, you must provide the following information:

    • Full Name

    • Address

    • Daytime Phone Number

    • Email Address

    • Valid Credit Card Information

7. Special Terms of Sale

  1. Your bid is a binding contract.

  2. All property is sold "AS IS" with no warranties.

  3. Any item not picked up on the scheduled pickup day without prior arrangements will be considered abandoned and become the property of the Auction Company.

  4. If you fail to pick up your items as scheduled, your credit card on file will be charged for the full purchase price.
